6. Your content & ownership
You retain all rights to files you upload (“User Content”). By uploading, you grant us a worldwide, royalty-free, non-exclusive license to process, store and transmit the User Content solely to deliver the Service to you. We never use your User Content to train AI models, re-sell data, or display advertising.
7. Our intellectual property
The PDFAPPLE name, logo, website design, documentation and source code are owned by PDFAPPLE Ltd. and protected by copyright, trademark and other laws. Nothing in these Terms transfers any of these rights to you.
8. Third-party services
The Service may link to or integrate with third-party services (e.g. Stripe, Dropbox, Google Drive). We are not responsible for the content, policies or practices of those services. Your use of them is governed by their own terms.
9. Disclaimer of warranties
The Service is provided “as is” and “as available.” Except where prohibited by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that conversion output will meet any specific requirement.
10. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability under these Terms for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us during the 12 months preceding the claim, or (b) £100. We shall not be liable for indirect, incidental, consequential, special, punitive or exemplary damages, including loss of data, revenue or profits.
Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded.
11. Indemnity
You agree to defend, indemnify and hold harmless PDFAPPLE Ltd., its officers, employees and affiliates from any claim, damage, loss or expense (including reasonable legal fees) arising out of (i) your User Content, (ii) your breach of these Terms, (iii) your violation of any law or the rights of any third party.
12. Termination
You may delete your account at any time. We may suspend or terminate your access immediately if you breach these Terms, if required by law, or for prolonged inactivity. On termination, all provisions that by their nature should survive (ownership, warranty disclaimers, limitations of liability, governing law) survive.
13. Governing law & disputes
These Terms are governed by the laws of England and Wales. Any dispute shall be submitted to the exclusive jurisdiction of the courts of London, except that we may seek injunctive relief in any competent court. Consumers resident in the EU retain the protections afforded by mandatory provisions of their local law.
14. Miscellaneous
- Entire agreement. These Terms, the Privacy Policy and any order form are the complete agreement between us.
- Assignment. You may not assign these Terms without our written consent. We may assign them freely in connection with a merger or acquisition.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any right is not a waiver of that right.
- Notice. Legal notices to us must be sent to [email protected] and by post to our registered office.
- Changes. We may update these Terms. We will post the new version and update the effective date; material changes get at least 14 days’ notice to logged-in users.
