2. Notice of infringement

To be effective under the DMCA, your notice must include:

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, with information reasonably sufficient to permit us to locate the material (please include URLs where possible).
  4. Information reasonably sufficient to permit us to contact you (name, address, telephone number and email).
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note: Section 512(f) of the DMCA provides that any person who knowingly materially misrepresents that material is infringing may be liable for damages. Do not make false claims.

3. Our response

Upon receipt of a complete and valid notice we will promptly:

4. Counter-notice

If you believe your material was removed in error, you may file a counter-notice including:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it previously appeared.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, phone number and consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, the courts of England & Wales), and acceptance of service of process from the person who filed the original notice.

Upon receipt of a valid counter-notice we will forward it to the original complainant. If the complainant does not file a court action seeking a restraining order within 10 business days, we may, in our discretion, restore the removed material.

5. Repeat infringers

In accordance with the DMCA and other applicable law we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts that are deemed to be repeat infringers. We may also terminate accounts for a single egregious infringement.

6. False claims

Please consider carefully before filing a DMCA notice. Fair-use, criticism, parody and transformative works may not require permission. If in doubt, consult a lawyer.

7. Non-US copyright holders

If you hold copyright under the law of a country other than the United States, we still welcome your takedown request. We handle UK, EU, Canadian, Australian and Japanese copyright notices under the same procedure, applying the equivalent local statute.
